Mengenal Sarbanes-Oxley


Sarbanes-Oxley sebenarnya sangat asing bagi saya, jujur saya pun baru mengetahui itu daro tugas yang di berikan oleh dosen saya. saya akan coba bahas Sarbanes-Oxley dengan sebisa saya dengan bantuan referensi yang sudah ada. berikut sekilas mengenai sejarah singkat tentang Sarbanes Oxley. 
Salah satu tema yang sangat menarik dalam Association Certified Fraud Examiner
(ACFE) Annual Fraud Conference ke-14 di Chicago adalah diterbitkannya SarbanesOxley Act
(SOX atau SOA). Undang-undang ini merupakan suatu terobosan dan sebagai reformasi
terbesar di USA khususnya dan dunia pada umumnya bagi penilaian corporate governance
sejak diterbitkannya Securities Acts of 1933 and 1934. Undang-undang tersebut diprakarsai oleh Senator Paul Sarbanes (Maryland) dan Representative Michael Oxley (Ohio). 
Undang-undang ini diterbitkan sebagai jawaban dari Kongres Amerika Serikat terhadap berbagai skandal pada beberapa korporasi besar seperti: Enron dan kemudian diikuti oleh WorIdCom, Qwest, Tyco, HeaIthSouth dan lain-lain, yang juga melibatkan beberapa Kantor Akuntan Publik (KAP) yang termasuk dalam kelompok lima besar "the big five" seperti: Arthur Andersen, PWC, dan KPMG. Semua skandal ini merupakan contoh yang tragis dan menyedihkan bagaimana skema kecurangan (fraud schemes) berdampak sangat buruk terhadap pemegang saham, pasar, pegawai dan masyarakat dalam arti luas. Dengan diberlakukannya undang-undang Sarbanes Oxley 2002 yang ditandatangani oleh Presiden George Walker Bush pada 30 Juli 2002 diharapkan dapat membawa dampak positif bagi berbagai profesi, antara lain : akuntan publik bersertifikat (CPA); kantor akuntan publik (KAP); perusahaan yang memperdagangkan sahamnya (listed di bursa US (termasuk direksi, komisaris, karyawan, dan pemegang saham); perantara (broker); penyalur (dealer); pengacara yang berpraktik untuk perusahaan publik; investor perbankan serta para analis keuangan. Penerapan undang-undang tersebut dilatarbelakangi oleh bangkrutnya sejumlah korporasi di Amerika Serikat. Dalam tulisan ini akan dibahas tentang : apa saja yang diatur dalam SOA dan bagaimana sanksi yang akan dijatuhkan jika aturan-aturan dalam SOA dilanggar.
Jadi menurut saya Kasus Enron yang sempat meruntuhkan Kantor Akuntan Publik Big One Arthur Anderson di seluruh dunia dan merumahkan puluhan ribu tenaga akuntannya. Akibatnya, pemerintah Amerika tentu sangant khawatir karena dampak dari skandal ini sangat luar biasa, bisa melunturkan kepercayaan publik kepada professi akuntan, pasar modal dan sisitem keuangan kapitalis yang dibangun dengan sentimen pasar modal ini.
Sebenarnya kalau dikaji lebih dalam inti permasalahannya adalah upaya menerapkan lebih tajam tata kerja yang baik sesuai ketentuan yang berlaku yang sudah dimiliki oleh semua profesi termasuk semua profesi akuntan.

I think learning English is very exciting and fun, but it depends on the teacher or lecturer who taught us. I have the experience of learning English is not enough to forget my life, both when I was in second grade high school. I was taught by him in which, according to the kids at my school is famous for its fierce and bitchy. but all that changed nearly 180 degrees when he taught the material to us all. He is very friendly, good, and know the character of each student through a method he called learning by doing. the method is quite frightening the students at first, but that just adds insight into the methods of English language students. students are given a chance one by one to speak to the class each week in turn. He was very patient justify the wrong word for word to pronounce with his distinctive style of humor. and every week he gives a quiz or a question that his time is only 10 seconds to collect the answer. in addition to the added value given to the students, he also gives gifts of chocolate candy or the ten people who collect the quickest response.

That experience and methods of learning English I think I've ever experienced, and until now I so want to learn English or the spirit of thanks to my high school teacher, he is an inspiration to me, because he is very tasty and easy to understand in explaining the subject material.
